Acceptance of Terms

By accessing and using the website located at sanleandromasonry.com, or by requesting or receiving masonry services from San Leandro Masonry & Concrete ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or engage our services.

Description of Services

San Leandro Masonry & Concrete provides residential and commercial masonry and concrete contractor services in San Leandro, CA and surrounding East Bay communities. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, masonry restoration, driveway pavers, walkway construction, stone masonry, fireplace installation, stone veneer installation, concrete block walls, and outdoor kitchen masonry.

Services are provided only to properties within our service area. We reserve the right to decline any project at our sole discretion.

Estimates and Pricing

All estimates provided by San Leandro Masonry & Concrete are based on an on-site assessment and are valid for 30 days from the date issued unless otherwise noted in writing. Estimates are not binding until a written contract or work order is signed by both parties.

Final pricing may change from an estimate if any of the following occur:

• Conditions discovered during the work that were not visible or accessible during the initial assessment (for example, hidden water damage or deteriorated materials uncovered during demolition).
• Changes to the scope of work requested by the customer after the work order has been signed.
• Material cost increases beyond our control between the date of the estimate and the date work begins.

Any price change will be communicated to you before additional work proceeds. We will not charge for unanticipated work without your approval.

Scheduling and Cancellation

Jobs are scheduled after a signed work order and any required deposit are received. Scheduling is subject to availability. We will confirm your start date in writing or by phone.

If you need to cancel or reschedule a confirmed job, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a cancellation fee to cover scheduling costs and lost time.

We reserve the right to reschedule work due to weather conditions, permit delays, or circumstances beyond our control. We will notify you as promptly as possible and reschedule at the earliest available time.

Payment Terms

Payment terms are outlined in your written work order or contract. In general:

• A deposit may be required before work begins. The amount will be stated in your work order.
• Final payment is due upon completion of the work unless otherwise agreed in writing.
• Accepted payment methods will be specified in your work order.
• Invoices not paid within 30 days of the due date may be subject to a late fee and/or referral to a collections agency.

Title and ownership of any materials installed on your property passes to you upon full payment of all amounts due.

Warranty Disclaimer

We stand behind the quality of our workmanship. Any warranty terms applicable to your specific project will be stated in your written work order.

Our workmanship warranty does not cover:

• Damage caused by events outside our control, including earthquakes, flooding, acts of nature, or soil movement that was not foreseeable at the time of the repair.
• Damage resulting from misuse, improper maintenance, or modifications to the work performed by another party.
• Normal wear and weathering of materials over time.
• Damage caused by conditions that existed prior to our work and were outside the scope of the agreed project.

Manufacturer warranties on materials are separate from our workmanship warranty and are subject to the terms set by each manufacturer.

EXCEPT AS EXPRESSLY STATED IN A WRITTEN WORK ORDER, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability

To the fullest extent permitted by law, San Leandro Masonry & Concrete shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from our services or from your use of our website.

Our total liability for any claim related to services performed is limited to the amount paid by you for those specific services. This limitation applies regardless of the legal theory under which the claim is brought.

Customer Responsibilities

To allow us to perform work safely and efficiently, you agree to:

• Provide safe and reasonable access to the work area on scheduled work days.
• Remove or secure personal property, vehicles, and pets away from the work zone as needed.
• Notify us promptly of any concerns or changes to the project before or during the work.
• Ensure that any required permits have been discussed and agreed upon before work begins.

Dispute Resolution

If we are unable to resolve the dispute informally within 30 days, both parties agree to submit the dispute to binding arbitration in San Leandro, CA, conducted under the rules of a mutually agreed-upon arbitration provider. Each party shall bear their own costs unless the arbitrator determines otherwise.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the appropriate courts located in Alameda County, California.

Modifications to These Terms
